Initially, when you are filing for a trademark, one of the things you have to do is conduct a clearance or a preliminary search on whatever it is you want to trademark. Every private label seller should go to uspto.gov and conduct a search to see if your product has already been trademarked.
Next, you’re going to begin the initial application process. This is a pretty simple process. You’re going to be filling out the information for your company to own your mark: the legal owner of the trademark, the business address, the first use and date of trademark, the class of goods you are trademarking, etc.
The last process of the application is your electronic signature.
If you are first to use the trademark, you have the rights to it.
In China it is the opposite. China is entirely first to register or first to file.
