Brands asserting IP Complaints against Amazon Sellers for Parallel Import Violations
Hello, everyone. My name is Alexa. Today I’m here to speak with you about intellectual property complaints. Specifically, trademark / parallel import complaints on Amazon.
Now, you may receive these types of complaints if you list U.S. brands on foreign marketplaces such as France, Spain, or any of the other European marketplace.
The brands that can come after you range from Yankee Candle, all the way to Nike, so you really want to be careful what you are listing on foreign marketplaces because they can assert this complaint just knowing that you are unauthorized to import the products over into these marketplaces.
You have two options when you get these IP complaints:
First, you can try to reach out to the complainant (Amazon provides their information to you in their notice) to try to request a retraction.
If you don’t have any sales, you have an alternative option, where you can just go to Amazon through their appeal process.
Both have their pros and cons, and if you can be successful through retractions, that’s the easier way to go about it. Amazon does have this option to appeal, so please remember that when you deal with these types of complaints.
